INTRODUCTION

This Privacy Notice explains how Adriatic Marinas d.o.o. Tivat and its associated legal entities: PM Power d.o.o. Tivat, Synchro PM1 d.o.o. Tivat, Synchro PM2 d.o.o. Tivat, Synchro North d.o.o. Tivat, Sportsko rekreativno drustvo “Porto Montenegro”, Jedrilicarski klub “Porto Montenegro Yacht Club” (collectively “Adriatic Marinas”, “we” or “us”) collect and process your personal data provided for the purpose of registering your interest in working with us.

We ensure that the data you supply is processed fairly, lawfully, with skill and care, and used only for the purposes set out in this Privacy Notice.

Your provision of personal data is voluntary but necessary and constitutes an essential requisite for the pursuit of the described purpose. Failure to provide your data will make it impossible to evaluate your profile and your professional aptitudes with respect to the role to be filled or any future positions that may be available and will not allow us to proceed with the selection activities for the purpose of possible establishment of the employment relationship.

Adriatic Marinas is bound by the Personal Data Protection Law (Official Gazette of Montenegro No. 79/2008, 70/2009, 44/2012, 22/2017, 77/2024) (the “Law”). Any personal data we hold will be governed by the most current version of the Law.

PERSONAL DATA WE COLLECT

Personal data means any information about an individual from which that person can be identified. The type of personal data we collect depends on what you decide to share with us when you send or provide us with your application/resume.

In the context of our recruitment activities, we may collect the following categories of personal data relating to you as a candidate:

• Identification details: full name, date of birth, gender, and citizenship;
• Contact information: residential address, telephone number(s), email address, and, where applicable, online communication identifiers (e.g., Skype ID, social media or professional network URLs);
• Visual identifiers: photographs you provide;
• Professional information: details of your employment history, education, qualifications, professional credentials, skills, and memberships in professional organizations;
• References and background information: information obtained from former employers, professional references, or other third parties lawfully providing such data;
• Other information: any data you voluntarily provide or that we may reasonably obtain in connection with your potential employment or work placement.

When applying for a job with us, we encourage you not to provide sensitive personal data (e.g. personal identification numbers, payment card numbers, information related to racial or ethnic origin, political opinions, religious or other beliefs, health data, sexual orientation, biometric or genetic data, or trade union membership).

HOW IS YOUR PERSONAL DATA COLLECTED

We may collect your personal data through the following means:

• Via our careers website: https://www.portomontenegro.com/careers/;
• Direct interactions, such as at career fairs, networking events, office visits, or similar occasions;
• Correspondence by post, telephone, email, by filling in forms, or other communications;
• Referrals, third parties, or publicly available sources.

This applies to applicants for all job roles advertised or promoted by Adriatic Marinas, as well as speculative applications not linked to a specific vacancy.

Any personal data that you provide through third parties will be subject to the third party’s privacy policy, rather than this Privacy Notice.

If you provide personal data about other people to us, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Notice.

HOW WE USE YOUR PERSONAL DATA

We may use your personal data for the following purposes:

• To assess your suitability for the role you applied for;
• To evaluate your profile against other potential vacancies, and to contact you regarding such opportunities;
• To verify references and conduct background checks where appropriate;
• To compile aggregated statistical information (e.g. diversity reporting) of our candidates. Any published product will refer only to larger aggregations of individuals and will not identify you personally or include any results attributable to you;
• To notify you of vacancies, career fairs, or other employment-related opportunities that may be of interest;
• To conduct candidate satisfaction surveys;
• To confirm the accuracy and currency of the information we hold about you.

You may object at any time to us keeping your personal data (see the Enquiries & Complaints section below).

We may also process your personal data without your knowledge or consent, where required or permitted by law.

We will not use your personal data for press releases or direct marketing without your consent.

WHERE WE STORE YOUR PERSONAL DATA

We are storing your personal data in our Applicant Tracking System provided by an external software vendor Agilcon d.o.o., Cara Lazara 5-7, 11000 Belgrade, Serbia; Infrastructure Provider (Sub-processor): Amazon Web Services EMEA SARL
38 Avenue John F. Kennedy, L-1855, Luxembourg (Physical Server Location: Stockholm, Sweden).

We have ensured to have an effective data processing agreement that obliges Agilcon d.o.o. to follow all applicable privacy and data protection regulations relevant to its own processing of the personal data concerned.

Your data will be processed in electronic and paper form and your data will be collected and stored in computer databases and may be stored in paper archives.

WHO CAN ACCESS YOUR PERSONAL DATA?

Your personal data may be disclosed to Adriatic Marinas’ employees, being transferred from sources to hiring managers to hiring team members, so they can assess your suitability for vacancies within different departments or contact you.

We do not sell your personal data to third parties.

RETENTION PERIOD

We will retain your personal data for no longer than three (3) years from the date of receipt, unless an employment relationship is established. In that case, data will be retained for the period required by applicable law.

DATA SECURITY

We implement reasonable technical, organizational, and personnel measures to protect personal data under our control from loss, misuse, and unauthorized alteration.

However, no system for transmitting data over the Internet or storing it electronically can be guaranteed as fully secure.

We would, however, appreciate the chance to deal with your concerns before you approach the Agency so please contact us in the first instance.
